Terms and Conditions
Effective Date: January 1, 2024
At HARP Firearms Training and Defense LLC d/b/a HARP FTD ("we," "us," or "our"), we are committed to providing high-quality services and ensuring that our customers have a positive experience. To help manage expectations and clarify our processes, we have outlined the following Chargeback Terms and Conditions. By completing a transaction with us, you (the "Customer") agree to these terms. If you have any questions about this policy, please contact us at office@harpftd.com.
1. Refund, Cancellation, and Rescheduling Policy
At HARP FTD, we strive to be transparent about our policies. Please review the following terms regarding refunds, cancellations, and rescheduling:
Refund and Deposit Policy
- No Refunds: HARP FTD does not refund deposits or tuition fees once paid. This policy is in place due to the nature of our services, including preparation and materials associated with your course.
Rescheduling Policy
- One-Time Reschedule: We allow one (1) free reschedule of your course or class date. If you need to reschedule, please contact us at least five (5) business days before your scheduled class date to request a new date. Rescheduling must occur within thirty (30) business days of the original class date, subject to availability.
Class Cancellations by HARP FTD
- HARP FTD Cancellation: In the rare event that HARP FTD needs to cancel or move a class to another date, you will have the choice of either:
- A full refund of any payments made, or
- The option to reschedule your class to another date that works for you.
We will make every reasonable effort to notify you promptly if a cancellation or change to the class schedule is necessary.
2. Chargeback Policy
We take chargebacks seriously and believe in resolving disputes fairly and promptly. Chargebacks occur when a customer contacts their bank or card issuer to dispute a transaction. We ask that you attempt to resolve any issues directly with us before initiating a chargeback.
Chargeback Conditions
You agree that chargebacks will only be initiated after reasonable attempts to resolve any issues directly with HARP FTD. If you initiate a chargeback without first attempting to resolve the matter with us, you may be subject to the following consequences:
- Fraudulent Transactions: If you believe a transaction was unauthorized or fraudulent, please contact us immediately at office@harpftd.com. We will work with you to resolve any issues and investigate any potential fraud claims.
- Goods or Services Not Provided: If you dispute the charge because you did not receive the service as described, you must provide documentation to support your claim. This may include email communications, proof of registration, or class attendance records. If the service was not delivered as promised, we will issue a full or partial refund as per our Refund and Rescheduling Policy.
Chargeback Fee
If a chargeback is initiated and we find the chargeback to be invalid or unjustified, HARP FTD reserves the right to charge a chargeback fee of up to $25 to cover the administrative costs incurred in managing the dispute. This fee will be added to any outstanding balance due.
3. Dispute Resolution Process
If you have a dispute regarding a transaction, we encourage you to contact us directly at office@harpftd.com to resolve the issue as quickly as possible. We value our relationship with you and want to address any concerns before they escalate to a chargeback.
Timeframe for Disputes
Under the Fair Credit Billing Act (FCBA), consumers have up to 60 days from the statement date to dispute a charge. We encourage you to contact us promptly if you believe there is an issue with your transaction.
4. Merchant’s Right to Dispute Chargebacks
If a chargeback is initiated, we have the right to dispute the chargeback by providing evidence that the transaction was legitimate. This evidence may include:
- Signed agreements or contracts.
- Proof of service delivery, such as class attendance records, communications, or other documentation.
- Transaction receipts or payment confirmations.
- A copy of our Refund and Rescheduling Policy to demonstrate the terms were communicated and agreed to at the time of registration.
We will work with the payment processor and card issuer to resolve any disputes.
5. Legal Compliance
This chargeback policy is governed by Maryland state law and federal regulations, including the Fair Credit Billing Act (FCBA) and the Electronic Fund Transfer Act (EFTA). Both parties agree to comply with all applicable laws regarding chargebacks and dispute resolution.
6. Chargeback Risk and Fees
In the event that a chargeback is initiated and upheld, the amount of the chargeback will be deducted from your account. Additionally, a chargeback fee may be applied as specified in this policy. Repeated chargebacks may result in the termination of your access to our services, along with the imposition of higher fees. We reserve the right to pursue legal action to recover any funds lost due to chargebacks and related fees.
7. Prevention of Fraud
We take fraud prevention seriously and employ various security measures to safeguard all transactions. However, if you believe a transaction has been made without your authorization, please report it immediately. Fraudulent activity is subject to investigation, and we will cooperate with the appropriate authorities to resolve any fraudulent claims.
8. Modifications to the Chargeback Policy
HARP FTD reserves the right to modify or update this chargeback policy at any time. Any changes to the policy will be posted on this page with an updated effective date. By continuing to use our services after any modifications are posted, you agree to the updated terms and conditions.
